Litigation Department Wins Cases For Clients
August 15, 2008–The DHH Litigation Department continues to produce results for injured clients. Craig Heidemann and Nathan Duncan recently achieved a $400,000.00 settlement with State Farm Insurance for a client who was injured in a motor vehicle accident when she was hit head-on by a drunk driver. The $400,000 represented the first and last demand made by the firm. Faced with overwhelming proof of liability and our client’s severe injuries, State Farm had no choice but to pay 100% of the amount asked for.
Earlier, Heidemann settled a complicated litigation case involving a client who was rear-ended waiting to cross railroad tracks on James River Expressway near Highway 65. Our client was severely injured and unable to return to work without major restrictions. The other side claimed that our client was not injured or alternatively, was injured before the accident. We proved that diagnostic studies before the crash proved our client to be healthy. The client recovered his worker’s compensation disability payment and received $400,000 from the insurance companies representing the responsible party.
Our Employment Litigation team recently recovered $22,000 for a police officer who was discharged after becoming pregnant. Continuing this winning streak, the Employment Litigation team also recovered $43,000 for an employee of the Missouri Veterans Home who was fired because she had Multiple Sclerosis.
Our Civil Rights Department continued its string of unparalleled successes when it recently won $45,000 for a client who was illegally imprisoned in the Greene County jail for nine months. After being arrested on an out of state warrant, jail employees failed to bring the client before a judge for extradition. Other cases currently in litigation include a federal prisoner who died after being refused pace-maker checks and then suffered a fatal heart attack; another in custody death case involving a young man who suffocated after being hog tied by law enforcement; and a failure to protect case where a county inmate was nearly beaten to death after being put in a cell with known violent individuals.
The litigation department also recently recovered a $150,000 settlement for wrongful death of a man hit head-on by a semi-tractor trailer in Camden County. The settlement was split between the decedent’s surviving spouse and his daughter.
